Will Brussels OK State Aid for Adria?
The Commission launched an investigation in November 2012 over doubts regarding compliance, including in capital injections executed in 2007, 2009, 2010 and 2011.
The bulk of the recapitalisation funds was secured by state state-run KAD fund, the former state-firm for restructuring PDP, and EUR 50m in 2011 by the state directly.
One of the potential issues highlighted by the Commission when it launched the investigation was that the PDP and state-owned port operator Aerodrom Ljubljana ended up with 52.3% and 47.7% stakes in what was then Adria's aircraft maintenance subsidiary Adria Airways Tehnika.
If the Commission had concluded illegitimate state aid had been provided, it could have demanded from Adria to return the funds. This for instance happened at sports goods manufacturer Elan, which was told to pay back EUR 10m.
