Janša's MP Status Restored
In the preliminary decision issued on Friday, the court skirts the issue of whether the National Assembly acted lawfully in revoking Janša's term, which had been a major sticking point during the parliament's decision-making.
Instead, it focuses on the lack of an effective legal remedy against such a decision, noting that Janša had no viable avenue to appeal the decision, even though such an option should exist given the overarching demands laid down in the Constitution.
Consequently, the court decided to initiate a constitutional review of the entire act on MPs, whose provisions formed the basis for the revocation of Janša's term.
There were three dissenting opinions focusing mainly on the fact that launching a constitutional review of the deputies act is unnecessary.
However, one judge, Etelka Korpič Horvat, whose opinion was co-signed by Jasna Pogačar, also voted against the temporary reinstatement of Janša's MP status, arguing that it prejudges the final outcome.
